I have been told by several collectors that the laws apply to public lands only, not private property. Does anyone know if that is the case or not?

The Archaeological Resources Protection Act (ARPA) of 1979 has taken the place of the Antiquities Act for purposes of antiquities violations. ARPA recognizes first that archaeological resources are non-renewable and second, that they are endangered because of a growing commercial market. ARPA sets criminal penalties at $10,000 and/or one year imprisonment. If the value of the resources involved exceeds $500, penalties are $20,000 and/or two years. For a second or repeat offense, penalties are $100,000 and/or five years.

What this means is, it is illegal to collect arrowheads from the surface, but one cannot be fined under the criminal penalites in ARPA. Collecting arrowheads from the surface is included under the prohibited acts listed under ARPA Section 6, Subsections a, b, and c. Arrowheads collected from the surface are still subject to forfeiture under ARPA.
